1. Interpretation and Definitions

Words with capitalised initial letters have meanings defined below. These definitions apply whether the words appear in singular or plural.
Definitions
For these Terms and Conditions:
- Affiliate means an entity that controls, is controlled by, or is under common control with a party, where control means ownership of 50% or more of voting rights or equity interests.
- The country refers to New South Wales, Australia.
- Company, we, us, or our refers to Q Skills Pty Ltd.
- Device means any device capable of accessing the Service, including a computer, mobile phone, or tablet.
- Service means the website operated by the Company.
- Terms means these Terms and Conditions.
- Third-Party Services means services or content provided by third parties that may be displayed or linked through the Service.
- Website refers to Q Skills, accessible at https://qskills.com.au/.
You means the individual or legal entity accessing or using the Service.
2. Acknowledgement and Acceptance
These Terms and Conditions govern your access to and use of the Service and Q Skills facilities and form a legally binding agreement between you and the Company. By accessing, booking, or using the Service or Q Skills facilities, you confirm that you have read, understood, and agree to comply with these Terms and Conditions.
If you do not agree to any part of these Terms, you must not use the Service or facilities. You confirm that you are at least 18 years of age. The Service and facilities are not intended for individuals under 18.
These Terms apply to all users, including Registered Training Organisations (RTOs), caterers, hospitality businesses, and any other approved users. Your use of the Service is also subject to our Privacy Policy, which explains how we collect, use, and protect personal information in accordance with Australian privacy laws.
3. Links to Other Websites
The Service may contain links to third-party websites or services that are not owned or controlled by the Company. We are not responsible for the content, privacy policies, or practices of third-party websites or services. You access third-party websites at your own risk.
4. Governing Law
These Terms are governed by the laws of New South Wales, Australia, and the laws of the Commonwealth of Australia.
5. Booking Requirements
- Bookings must be made through approved channels and confirmed in writing.
- Q Skills may request business or licensing documentation before approving a booking.
- Bookings are not transferable unless approved by Q Skills.
6. Access and Security
- Access is available only for the times specified in your booking.
- Keys, access cards or digital codes must not be shared.
- The Hirer is responsible for securing the area after use unless otherwise arranged.
7. Use of Facilities
The Hirer must:
- Use the kitchen only for approved cooking, catering or training activities.
- Follow Q Skills operational instructions and safety procedures.
- Ensure all participants comply with hygiene and safety rules.
- Not alter, damage or remove equipment or fixtures.
8. Equipment
- Use only the equipment included in your booking.
- Report faults or damages immediately.
- Costs for repair or replacement caused by misuse may be charged to the Hirer.
9. Cleaning Requirements
Before leaving, the Hirer must ensure:
- Surfaces, benches and equipment are cleaned
- Utensils are washed, dried and stored
- Floors are cleaned
- Food waste is removed
- Bins are emptied into the appropriate disposal points
Extra cleaning fees may apply if standards are not met.
10. Fees and Payment
- Fees must be paid in full before access unless agreed otherwise.
- Additional charges may apply for extended use, damages, cleaning or extra equipment.
- Invoices must be paid by the stated due date.
11. Cancellation Policy
Refunds are based on notice given:
- More than 7 days: Full refund
- 72 hours – 7 days: 50% refund
- Less than 72 hours: No refund
Rescheduling is subject to availability.
12. Insurance Requirements
The Hirer must hold:
- Public liability insurance
- Any required food safety or business insurance
- Professional indemnity insurance (RTOs delivering training)
Evidence of insurance may be requested.
13. Health, Safety & Compliance
The Hirer must comply with:
- WHS laws
- Food safety regulations
- Local council rules
- Q Skills induction and safety procedures
Incidents must be reported immediately.
14. Behaviour Standards
The Hirer must ensure that participants:
- Behave professionally
- Follow safety directions
- Do not engage in unsafe or unlawful conduct
Q Skills may require individuals to leave if their behaviour is unsafe or inappropriate.
15. Liability
Q Skills is not responsible for:
- Loss or damage to personal belongings
- Injuries resulting from unsafe practices by the Hirer
- Food safety breaches caused by the Hirer
The Hirer indemnifies Q Skills for any claims arising from:
- Breach of these Terms
- Damage to property
- Unsafe food handling
- Participant actions
16. Termination of Use
Q Skills may immediately terminate access if:
- Terms are breached
- Damage occurs
- Payments are not made
- Unsafe or unlawful behaviour occurs
No refunds apply where termination results from the Hirer’s breach.
17. Privacy
Personal information is handled in line with the Q Skills Privacy Policy.
18. Changes to Terms
We may update these Terms from time to time. Material changes will be published on this website at least 30 days before taking effect. Your continued use of the Service constitutes acceptance of the updated Terms.
